Terms of Use

1. Who we are and what these terms cover
Welcome to HayBiz.us ("HayBiz," "we," "us," or "our"), a bilingual (English / Հայերեն) online job board serving the Armenian community. HayBiz is operated by AAGMA Inc. These Terms of Use ("Terms") are a legal agreement between you and AAGMA Inc, and they govern your access to and use of the HayBiz website at https://haybiz.us and any related services (together, the "Service").
By accessing or using the Service — whether you browse listings, create an account, post a job, or apply to one — you agree to these Terms and to our Privacy Policy, Cookie Policy, and Acceptable Use & Non-Discrimination Policy, which are incorporated here by reference. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service, and old enough to form a binding contract under the laws of your state. The Service is intended for users in the United States. By using the Service you represent that you meet these requirements and that all information you provide is accurate.
3. Your account
Some features (such as posting a job, saving jobs, or managing an employer dashboard) require an account. When you create one, you agree to:
- provide accurate, current information;
- keep your password confidential and not share your account;
- be responsible for everything that happens under your account; and
- notify us promptly at haybiz.us@gmail.com if you suspect unauthorized use.
We may suspend or close accounts that violate these Terms, as described in Section 13.
4. What HayBiz is — and what it is not
HayBiz is a neutral venue that lets employers post job opportunities and lets job seekers find and respond to them. We are not an employer, a recruiter, an employment agency, or a party to any hiring decision, interview, offer, contract, or relationship between employers and job seekers.
We do not:
- guarantee that any listing is accurate, current, legitimate, or lawful;
- guarantee that any application will be delivered, read, or answered;
- guarantee that any job will be filled or that any applicant will be hired;
- verify the identity, background, licensing, or trustworthiness of any employer or job seeker; or
- endorse any employer, job seeker, listing, or third party.
You are responsible for your own decisions. Always verify the details of a listing or an applicant independently before sharing sensitive personal information, sending money, accepting an offer, or beginning work. Legitimate employers do not ask you to pay fees to apply, to buy equipment through them, or to send money to receive a job. 5. Terms for job seekers
If you use HayBiz to look for work or apply to listings:
- You may submit information such as your name, contact details, a message, and resume or photo files. You are responsible for the accuracy of what you submit and for making sure you have the right to share it.
- When you apply to a listing, your application and any attached files are shared with the employer who posted it and with HayBiz administrators for moderation. Once shared with an employer, HayBiz does not control how that employer uses your information — review the employer's own practices before applying.
- Do not submit false information, apply on behalf of someone else without permission, or upload files that contain another person's private information without their consent.
6. Terms for employers and job posters
If you post a listing on HayBiz:
- Approval. Listings are reviewed by an administrator before they appear. We may approve, decline, edit for formatting, reject, or remove any listing at our discretion, with or without notice.
- Accuracy and legality. You are solely responsible for the content of your listing and for ensuring it is truthful, lawful, and describes a real opportunity. You must have the authority to post it.
- Employment law compliance. You are responsible for complying with all laws that apply to hiring and job advertising, including anti-discrimination and equal-opportunity laws (see the Acceptable Use & Non-Discrimination Policy). Job ads must not express unlawful preferences or exclusions based on protected characteristics.
- Applicant data. If you receive applications, resumes, or personal information through HayBiz, you agree to handle that information lawfully, use it only for legitimate hiring purposes, and protect it appropriately.
- No misuse. You may not use listings to collect personal data for unrelated purposes, to advertise something other than a genuine opportunity, to run a scam, or to solicit fees from applicants.
7. Content you provide and the license you grant us
You keep ownership of the content you submit — your listings, messages, resumes, photos, and other materials ("User Content"). To operate the Service, you grant HayBiz a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, format, and distribute your User Content for the purpose of running and promoting the Service — for example, showing your job listing to job seekers, or delivering your application to an employer. This license lasts only as long as we host your content; it ends when your content is removed or your account is deleted, except for copies retained in routine backups or as required by law.
You represent that you own or have the necessary rights to your User Content and that it does not violate anyone else's rights or any law.
8. Acceptable use
Your use of HayBiz is subject to our Acceptable Use & Non-Discrimination Policy. At a minimum, you agree not to post content that is false, fraudulent, discriminatory, harassing, obscene, illegal, or harmful, and not to misuse, scrape, overload, hack, or interfere with the Service. Violations may result in removal of content and termination of your access.
9. Intellectual property and copyright complaints (DMCA)
The HayBiz name, logo, design, and the software and text we create are owned by HayBiz or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or reuse them without permission, except for the normal, personal use of the Service.
We respect intellectual-property rights and expect users to do the same. If you believe content on HayBiz infringes your copyright, send a notice to haybiz.us@gmail.com including: (a) identification of the work; (b) the location (URL) of the material on HayBiz; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (f) your physical or electronic signature. We will respond to valid notices, including by removing infringing material and, where appropriate, terminating repeat infringers.
10. Disclaimers ("as is")
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from the listings, applicants, employers, or third parties you encounter through the Service. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content is accurate or reliable. To the fullest extent permitted by law, we disclaim responsibility for the conduct of any user and for any transaction, communication, interview, offer, or employment relationship arising from the Service.
11. Limitation of liability
To the fullest extent permitted by law, HayBiz and its owner, operators, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or related to your use of (or inability to use) the Service — including any dealings with employers, job seekers, or third parties — even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, the total liability of HayBiz for all claims relating to the Service will not exceed one hundred U.S. dollars ($100), or the amount you paid us in the past 12 months, whichever is greater. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless HayBiz and its owner and operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms or any law; or (d) your violation of any third party's rights. This includes claims arising from a listing you posted or an application you submitted.
13. Suspension and termination
You may stop using the Service at any time and may request deletion of your account by contacting haybiz.us@gmail.com. We may suspend, restrict, or terminate your access, and remove any content, at any time — with or without notice — if we believe you have violated these Terms or any policy, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination (including Sections 7, 10, 11, 12, 14, and 15) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. Before filing any claim, you agree to first contact us at haybiz.us@gmail.com and attempt to resolve the dispute informally in good faith.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date and, for material changes, provide reasonable notice (such as a notice on the site). Your continued use of the Service after changes take effect means you accept the updated Terms.
16. SMS terms (HayBiz Job Alerts)
By subscribing to HayBiz Job Alerts you agree to receive recurring marketing text messages about new job listings from HayBiz (AAGMA Inc) at the phone number you provide. Consent is not a condition of using the Service. Message frequency varies (up to 4 messages per week). Message and data rates may apply. Reply HELP for help or email haybiz.us@gmail.com. Reply STOP to cancel at any time. Carriers are not liable for delayed or undelivered messages.
17. General
These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use & Non-Discrimination Policy, are the entire agreement between you and HayBiz regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, sale, or reorganization.
